ACC can fire employee without cause

Former Anti-Corruption Commission-ACC officer Sharif Uddin will not be able to return to work. The Appellate Division allowed the ACC's appeal against the annulment of a rule 54(2) relating to the removal of an ACC employee without showing cause. The Appellate Division headed by Chief Justice Hasan Faiz Siddiqui gave the verdict today. As a result, dismissed ACC officer Sharif Uddin will not be able to return to work.

Rule 54 (2) of the ACC (Employees) Employment Rules, 2008 states that the competent authority may terminate an employee from service without assigning any reason by giving ninety days' notice or payment of ninety days' salary in cash.

Md. Ahsan Ali, an ACC officer was removed from his service according to rule 54 (2) of the ACC (Employees) Employment Rules . Later he filed a writ challenging the very rule. In terms of that writ, the High Court declared the cancellation of that rule in 2011. Later, the ACC went to the Appellate Division against it.

ACC lawyer Khurshid Alam Khan said, 'After the Supreme Court's verdict, ACC can dismiss any of its officers without assigning any reason. Such a provision is necessary for the ACC to control any dishonest officer as it is a very sensitive institution.'
