HC drops Dr Kamal's plea from cause list

The High Court today dropped from its cause list the writ petition, filed by Dr Kamal Hossain and Associates challenging the Taxes Appellate Tribunal's decision that upheld the National Board of Revenue's assessment of Taka 6.85-crore tax evasion by the law firm in fiscal 2018-2019.

A bench of Justice Syed Refaat Ahmed and Justice Muhammad Mahbub Ul Islam dropped the matter this afternoon.

Senior lawyer Rokanuddin Mahmud, Barrister Mustafizur Rahman and Barrister Tanim Hossain Shawon stood for Dr Kamal's firm while deputy attorney general Pratikar Chakma represented the state.

Lawyers, however, said there is a scope of submitting the writ petition before another bench of the High Court, which has jurisdiction to hear it.

According to the petition, law firm Dr Kamal Hossain and Associates submitted income tax return of over Taka 1.04 crore for the fiscal 2018-19, but the National Board of Revenue (NBR) claimed nearly Taka 6.85 crore in taxes and Taka 87 lakh more in interest by showing more than Taka 20.11 crore assets in Dr Kamal's name.

On December 30 in 2019, Dr Kamal appealed against the order issued by a deputy commissioner of taxes to a joint commissioner.
 
But, on June 25 in 2020, the Taxes Appellate Tribunal rejected his plea. Finally, his firm - Dr Kamal Hossain and Associates - challenged the decision in the High Court.
