The Appellate Division has stayed a High Court order that barred authorities from showing an accused person as “shown arrested” in a new case or arresting them in any fresh case without a specific allegation.
The order was passed today (Wednesday) by a four-member bench of the Appellate Division headed by Chief Justice Zubair Rahman Chowdhury.
Earlier, a High Court bench comprising Justice Razik-Al-Jalil and Justice Debashish Roy Chowdhury had ruled that no one could be arrested without a specific case. The bench had also issued a rule seeking an explanation on the matter.
The Appellate Division directed the High Court to dispose of the issued rule within four weeks.
Attorney General Mohammad Ruhul Quddus Kajol said the High Court’s order could have hampered the independent investigations of law enforcement agencies. He said that if such a restriction remained in place, authorities would not have been able to take action even when they had specific evidence against an individual.
