The High Court has issued a rule asking as to why the three years' jail sentence of Md Mizanur Rahman, suspended deputy inspector general of police, should not be altered and enhanced in the bribery case.
The bench of Justice Md Nazrul Islam Talukder and Justice Kazi Md Ejarul Haque Akondo issued the rule following a criminal revision petition filed by the Anti-Corruption Commission (ACC) seeking enhancement of Mizanur's punishment in the Tk 40 lakh bribery case.
The state and convicted Mizanur Rahman, who is now in jail, have been made respondents to the rule and they were asked to explain the ruling in four weeks.
On February 23, Dhaka Special Judge's Court sentenced Khandaker Enamul Basir, suspended director of ACC, and Mizanur Rahman, to eight and three years in jail, respectively in the case.
The Supreme Court chamber judge on Sunday upheld an order passed by another HC bench granting bail to Mizanur in the same case.
Justice M Enayetur Rahim, chamber judge of the SC's Appellate Division, passed "no order" on a petition filed by the ACC seeking stay on the HC order of bail.
The HC bench of Justice Md Mostafizur Rahman on April 13 granted two months' bail to Mizanur in the Tk 40 lakh bribery case in which he was sentenced to three years' imprisonment by the lower court on February 23.
